Welcome to bynUp! These Terms of Service ("Terms") govern your access to and use of the bynUp website builder platform, including any associated websites, services, and applications (collectively, the "Service").

By accessing or using the Service, you agree to be bound by these Terms. If you do not agree to these Terms, please do not use the Service.

1. Definitions

  • "bynUp," "we," "our," or "us" refers to the bynUp platform and its operator
  • "User," "you," or "your" refers to the individual or entity using the Service
  • "Content" refers to text, images, videos, products, and other materials uploaded or created through the Service
  • "Website" refers to a website built and published using our Service

2. Account Registration

To use certain features of the Service, you must register for an account. You agree to:

3.2 Payment Terms

By subscribing to a paid plan, you agree to pay all applicable fees. Payments are non-refundable except as required by law or explicitly stated in these Terms.

3.3 Free Plan

We offer a free plan with limited features. We reserve the right to modify or discontinue the free plan at any time with reasonable notice.

3.4 Cancellation

You may cancel your subscription at any time. Cancellation will take effect at the end of your current billing period. No refunds will be issued for partial billing periods.

4. Acceptable Use Policy

You agree not to use the Service to:

  • Violate any applicable laws or regulations
  • Infringe upon intellectual property rights of others
  • Distribute malware, viruses, or harmful code
  • Engage in phishing, spamming, or fraudulent activities
  • Harass, threaten, or harm others

  • Interfere with or disrupt the Service or its infrastructure
  • Scrape, crawl, or extract data from the Service without permission

We reserve the right to suspend or terminate accounts that violate this policy.

5. Your Content

5.1 Ownership

You retain all ownership rights to the Content you create and upload to bynUp. We do not claim ownership of your Content.

5.2 License to bynUp

By using the Service, you grant bynUp a worldwide, non-exclusive, royalty-free license to host, store, and display your Content solely for the purpose of providing the Service to you.

5.3 Responsibility

You are solely responsible for your Content and the consequences of publishing it. You represent and warrant that you have all necessary rights to your Content and that it does not violate these Terms or any applicable laws.

5.4 Content Removal

We reserve the right to remove any Content that violates these Terms or applicable laws. We will make reasonable efforts to notify you of such removal.

6. Intellectual Property

6.1 bynUp Property

The Service, including its design, code, templates, features, and branding (excluding your Content), is owned by bynUp and protected by copyright, trademark, and other intellectual property laws.

6.2 Templates

Templates provided by bynUp are licensed, not sold. You may use templates to build websites on our platform but may not resell, redistribute, or use them outside the Service.

6.3 Feedback

Any feedback, suggestions, or ideas you provide about the Service may be used by us without restriction or compensation.

7. Third-Party Services

The Service may integrate with or contain links to third-party services. We do not endorse or control these services and are not responsible for their content, privacy practices, or availability. Your use of third-party services is at your own risk.

8. Domain Names

If you connect a custom domain to your website, you are responsible for:

  • Purchasing and maintaining domain registration
  • Configuring DNS settings correctly
  • Complying with domain registrar terms

bynUp is not responsible for domain availability, registration, or renewal.

9. Service Availability

We strive to provide reliable service but do not guarantee uninterrupted access. The Service may be unavailable due to:

  • Scheduled maintenance
  • Unexpected technical issues
  • Factors beyond our reasonable control

We will make reasonable efforts to notify users of planned maintenance.

10. Limitation of Liability

To the maximum extent permitted by law:

  • bynUp shall not be liable for any indirect, incidental, special, consequential, or punitive damages
  • Our total liability shall not exceed the amount you paid us in the 12 months preceding the claim
  • The Service is provided "as is" without warranties of any kind

11. Indemnification

You agree to indemnify and hold harmless bynUp and its affiliates from any claims, damages, losses, or expenses arising from:

  • Your use of the Service
  • Your Content
  • Your violation of these Terms
  • Your violation of applicable laws or third-party rights

12. Termination

We may terminate or suspend your account immediately, without prior notice, for:

  • Violation of these Terms
  • Fraudulent or illegal activity

  • Extended period of inactivity

Upon termination, your right to use the Service will cease immediately. We may retain your Content as required by law or for legitimate business purposes.

13. Dispute Resolution

16.3 Waiver

Our failure to enforce any right or provision of these Terms shall not constitute a waiver of such right or provision.

16.4 Assignment

You may not assign these Terms without our written consent. We may assign these Terms without restriction.
